Future care needs in lifelong injury claims

Future care needs in lifelong injury claims cannot always be understood by looking only at the support a claimant requires today. A person living with the consequences of a serious neurological or physical injury may have needs that evolve considerably over decades as they age, their circumstances change and existing sources of support become less sustainable.

Today’s Independence May Depend on Tomorrow’s Variables

A claimant may manage relatively independently at 25 or 30, particularly after rehabilitation and with an established routine.

But ageing can change the demands placed on an already impaired system. Reduced strength, mobility or endurance may interact with longstanding disability. Transfers that are manageable now may become harder. Equipment may need replacing or adapting. An accessible home that works at one stage of life may not meet later requirements.

Future planning therefore requires more than simply extending today’s care arrangements across a lifetime.

What Happens When Informal Support Changes?

Family support can also shape apparent independence.

Parents, partners or other relatives may provide transport, prompting, supervision, household assistance or practical help without this always being described as formal care.

Those arrangements cannot necessarily be assumed to remain unchanged indefinitely.

An Occupational Therapy Expert Witness can help identify what support is currently being provided, how it contributes to the claimant’s functioning and what alternative provision may need to be considered as family circumstances change.

Planning for Equipment, Accommodation and Support

Future needs may extend across several interconnected areas.

An OT may consider personal care, domestic activities, mobility, equipment, assistive technology, accommodation, community participation and the level of support required to maintain safety and independence.

Crucially, recommendations should be individualised and clinically justified, rather than based simply on diagnosis or age.

Where appropriate, Occupational Therapy evidence may also sit alongside medical, neurological, neuropsychological, physiotherapy or other specialist opinions to ensure that future recommendations reflect the claimant’s wider prognosis.

Planning for a Lifetime Through Medico-Legal Healthcare

At Medico-Legal Healthcare, we provide access to experienced Occupational Therapists and multidisciplinary experts for complex personal injury and clinical negligence claims involving long-term care and rehabilitation needs. For solicitors, the value of specialist future-needs evidence lies in looking beyond what the claimant requires now. In lifelong injury claims, the more important question may be: how could those needs change across the claimant’s lifetime, and what provision may reasonably be required as they do?
